Web Form Information

When you submit information to Shortlister to open an account, submit a bid or solicit bids, we may collect personally identifiable information from you that may include (among other information) your name, address, email address, project information including schematics and drawings, specific bid information and type of work you solicit or perform. We do not knowingly collect personal information from persons under the age of eighteen.

How We Use Information Collected

We may use the information in the following ways:

  • To perform the actions for which you specifically provided the information. For example, enabling us to match solicitors and bidders for specific work requests.
  • To register you as a customer and establish an account for you.
  • To send you email notifications.
  • To enhance existing features or develop new features, products or services.
  • To allow us to personalize the content and advertising on Shortlister.net that you and other individuals see on Shortlister.net based on personal characteristics or preferences.
  • To provide registered users with aggregated job costing information that bidders on Shortlister.net provide.

Except as specifically set forth in this Privacy Policy, we will not share your personally identifiable information with any entity outside of Shortlister.net. We may disclose and use personally identifiable information in special circumstances where it is necessary or where we are legally obligated to provide such information. Shortlister Network Abuse Policy

Shortlister is an Internet marketplace for the efficient pairing of bidders and solicitors of construction-related projects.

Like other large Internet marketplaces, Shortlister has a network of solicitors and bidders who interact over Shortlister.net. If you have arrived at this page it is likely that you experienced a problem with one of the Shortlister members. Please follow the instructions below to resolve your complaint.

All Shortlister customers are prohibited from using our services in conjunction with any form of network abuse, spamming, spyware, denial of service, or other illegal activity. Clients may only send email and contact recipients who have requested such solicitation.

Please report any abuse of Shortlister resources promptly so that we can take corrective action against any offending accounts. Please send e-mail to info@shortlister.net to report any network abuse.

Shortlister Customer Contract

The Shortlister Customer Contract is the contract between the Company ("Shortlister") and the Shortlister Customer ("You"). By using Shortlister you consent to the following terms including the Privacy Policy posted on this website:

  1. You agree that Illinois law, excluding principles of conflict of law, will govern this agreement, and that any claim or suit arising out of or related to this agreement must be brought exclusively in federal or state courts located in Chicago, Illinois. You consent to the exclusive jurisdiction of such courts.
  2. You agree to assume full responsibility for your decision to use Shortlister affiliated services. THE COMPANY OFFERS THE SHORTLISTER SERVICE "AS IS" WITHOUT ANY WARRANTY OF ANY KIND, EITHER EXPRESSED OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT.
  3. You acknowledge and agree that I/our use of the Shortlister website is at your own risk and that Shortlister is not liable for any direct, indirect, incidental, consequential or punitive damages or any losses, costs or expenses of any kind which may arise, directly or indirectly through the access to, the use of, or the browsing in this site or through your downloading of any materials from this website, including but not limited to anything caused by any viruses, bugs, human action or inaction of any computer system or the failure of any Internet service provider.
  4. It is expressly understood that you and Shortlister are, in all respects, independent parties to a contract. This agreement does not create a relationship of principal and agent and neither party is to be construed as the legal representative of the other. Nothing contained in this agreement shall be construed to create a relationship of employer or employee, partnership, or joint venture, fiduciary or similar relationship between you and Shortlister, for any reason whatsoever. Consistent with the parties' status as independent contracting parties:
    1. You are not authorized to make any promise, warranty or representation on behalf of the Shortlister for any purpose.
    2. You agree that you shall not represent to any person that you are the agent of Shortlister, nor fail to correct any misunderstanding as to such status.
    3. You will not have the power or authority to, and agree that you will not, obligate or attempt to obligate Shortlister in any manner whatsoever.

  5. You agree that you are responsible to obtain all relevant licenses and permits associated with the legal operation of your enterprise. Furthermore, you agree to indemnify and hold the Company harmless for any damages or costs incurred as a result of your violation of any law, regardless of whether they are actual, incidental, consequential, or punitive.
  6. If You send (or cause to be sent) messages by electronic means (including but not limited to email and instant messages) or contact through telephonic mediums in connection with the direct or indirect receipt of contact information retained through Shortlister, then You represent and warrant the following:
    1. No such message or contact will be sent to any individual who has not explicitly requested to receive such messages or contact specifically from You or your company.
    2. No such message or contact will be sent to any individual who has explicitly requested to receive no further messages or contacts from You or your company.
    3. All such messages or contact will be in full compliance with federal and state laws and regulations governing commercial electronic mail, electronic messaging, and advertising.
    4. No such message or contact will include any false or misleading information regarding your identity, or the intent, subject, or origin of the message or contact.
    5. All such messages and contact will include accurate information regarding your identity, and the intent, subject, and origin of the message or contact.
    6. No such message will include any incomplete, invalid, misleading, fake, or forged message headers.
    7. All such messages will include complete, valid, and accurate message headers indicating the origin of the message.
    8. All such messages by email will include clear, valid, and conspicuously displayed From, Subject, Removal or Opt-Out information, and a functioning return address (or hyperlink) that 1) enables the recipient to submit a request to receive no further messages from You; and 2) remains capable of receiving such requests for no less than 30 days from the date the message was sent.
    9. No such message or contact will include any fraudulent, deceptive, false or misleading information.

  7. If You register a project with Shortlister, then:
    1. You represent that you have reviewed relevant Shortlister rules and policies, understand them and agree to abide by all of them.
    2. You agree that Shortlister may list your project in its marketplace and catalog and make it available for review and bid by other Shortlister members.
    3. You understand that Shortlister may delist any project from its marketplace at any time, without cause or notice.
    4. You agree to provide Shortlister with a valid email addresses for your project.

  8. You understand that the Company, in its sole discretion, may suspend your account(s) if the Company has reason to believe that you have been involved with any of the following conduct that is related in any manner to Shortlister or its customers:
    1. engaging in illegal activity;
    2. misrepresenting, over-promising or other acts in violation of federal or state law affecting consumer protection and commercial activities; or
    3. otherwise violating Shortlister rules or policies.

    You agree and understand that the Company's right to take any of the above actions does not constitute a right or obligation to take them for the benefit of any third parties, including You.
  9. Following the suspension of an account per Section 8 above, the Company will review conduct that appears to violate this Shortlister Customer Contract. This review will be conducted in a manner decided by the Company. You agree to cooperate with this review. If the review concludes that there is a reasonable basis to believe actionable misconduct has occurred, the Company may pursue remedies as allowed by law.
  10. You understand that the Company may freely assign or otherwise transfer any or all of the rights and obligations described under the Shortlister Customer Contract without your consent and without notice to You.
  11. You agree that if any provision of this Shortlister Customer Contract is declared or determined by any court to be illegal or invalid, the validity of the remaining parts, terms or provisions shall not be affected by that determination and the illegal or invalid part, term or provision shall not be deemed to be part of this Shortlister Customer Contract.
  12. You understand that the Company reserves the right to modify the Shortlister Customer Contract at any time.
  13. You agree to indemnity and hold harmless Shortlister, its officers, directors, agents and employees against any asserted claims or suits made by any third party for any and all damages, losses, judgements or liabilities arising from or relating to: (i) any actual or alleged breach of this Agreement by You; (ii) any content, data or material that you submit, post or otherwise provide to Shortlister or on this website.

Advertising Terms and Conditions

Advertising through Shortlister.net is subject to the following terms and conditions:

  • All advertising material is subject to approval by Shortlister, LLC, who reserves the right to reject or cancel any advertisement deemed to be unsuitable for any reason.
  • Fees paid for advertising are non-refundable unless the advertisement is cancelled prior to the commencement of the advertising campaign, which is defined as the moment the advertisement is first published on the Internet. To be clear, if the advertisement is cancelled prior to your agreed upon campaign duration, Shortlister, LLC will reimburse you for the days your advertisement did NOT appear on the Internet.
  • Advertising space is subject to limited availability and will be handed out on a first-come first-served basis. Once all of the available advertising slots are filled, further advertisements are queued (stored off-line) until the next available slot becomes available.
  • These terms and conditions are subject to change without prior notice. Updates will be made available through Shortlister.net so please check back often.
  • Rates (fees) are subject to change without prior notice. Only new or renewed contracts are affected when rates change.
  • Clicks are defined as anytime an advertisement is displayed to a visitor of our web site and that visitor clicks on your advertisement.
  • Shortlister, LLC is not bound to comply with advertiser instructions if they conflict with established policies.
  • All advertisements are positioned according to rules dictated by Shortlister, LLC.
  • The advertiser and any associated company(ies)/agency(ies) acknowledge that they own the rights and permissions to publish submitted material on the Internet. Each agrees jointly and severally to indemnify and save harmless Shortlister, LLC against all damage, loss, expense and liability of any nature arising from our use of the advertisers submitted graphic content on the Internet.
  • Shortlister, LLC assumes no liability for errors in materials. All attempts will be made to correct any errors that may appear.
  • Shortlister, LLC reserves the right to refuse or postpone the display of submitted advertising content until all monies have been received (including the clearing of bank checks) in full and advertising space becomes available.
  • Shortlister, LLC is not liable for delays in publishing or failure to publish submitted advertising content in the event of circumstances beyond the control of Shortlister, LLC.

Acceptance by the advertiser and any associated company(ies) or agency(ies) of these terms and conditions is implied upon the receipt of submitted advertising material and/or monies by Shortlister, LLC.
